Liability on Vision Zero Programs and Transportation Professionals

Webinar Description:

This webinar will explore the topic of public agency liability for transportation professionals involved in safety and specifically the factors of limiting liability and damages resulting from Vision Zero programs. We will identify how to select Vision Zero focused countermeasures in a way that minimizes possible exposure to liability and damages with attention given to successfully implementing innovative treatments. Presenters will outline what steps to take when a liability concern is raised in association with Vision Zero.

Transportation agencies often use standards, guidelines and threat of being sued as the reason to do or not to do something. We will review how to identify and document use of countermeasures that do not precisely follow a standard but where there might be precedent and have been utilized effectively in other states/provinces or countries. Presenters will provide general guidelines on how to document decisions and achieve discretionary immunity.

In addition, this webinar will consider how to measure and report Vision Zero-related serious injuries and fatalities statistics in a way that does not increase liability concerns.

Learning Objectives:
Attendees of this webinar will be able to:

  • Review the legal issues surrounding work of transportation agencies and gain some understanding of the legal responsibilities of transportation professionals
  • Understand current trends in Vision Zero programs and efforts to limit liability and damages from lawsuits or actions
  • Identify how liability decisions affect Vision Zero processes, publicly available Vision Zero data, selection of safety countermeasures and future practices of transportation professionals
  • Become familiar with examples of transportation tort claims related to Vision Zero programs
